This is the last Will and Testament of me Ephraim Sadler of Great Saughall in the County of Chester Yeoman I order and direct that all my just Debts Funeral and Testamentary expences be paid by my Executors and Trustees hereinafter named out of my personal estate as soon as conveniently may be after my decease And I hereby nominate constitute and appoint my two Sons John Sadler of Huxley in the said County Farmer and James Sadler of [Sealand?] in the said County Farmer and Miller Executors and Trustees of this my Will And I give and devise unto my said Executors and Trustees All my real Estate and hereditaments situate in the City of Chester and Huxley in the said County and all other my Freehold and personal Estate whatsoever and wheresoever and of what nature or kind soever and also the Interest of money from my personal property Upon Trust for my Executors and Trustees hereinbefore named and the Survivor of them and the heirs and assigns of such survivor do and shall as soon as conveniently may be after my decease make Sale and absolutely dispose of All my real estate and hereditaments situate in Huxley aforesaid in such manner and form and by such ways and means and at such time or times as may by them be thought expedient for the best price or sum that can be reasonably obtained for the same and do and shall Convey and Assure the said real estate and hereditaments when the same shall be sold unto the purchaser or purchasers thereof his her or their heirs or assigns or as he she or they shall direct And I further direct that my Real Estate and hereditaments situate in the City of Chester and consisting of a Chapel used as a place of Worship by the Primitive Methodists and of a Dwellinghouse attached thereto shall not be sold so long as they the Occupiers shall pay the Rent in full for the same And it is my Will and mind that the Rents arising from the said Chapel and House shall be divided annually between my three Sons John Sadler, James Sadler and Amos Sadler these shares to become payable to my said three Sons annually after my decease And I having given up to my Son Ephraim my Farm at Great Saughall I consider by so doing that his share is equal to my last named three Sons without giving him any share in the said Chapel and House or the rents thereof And if either of my said Sons should happen to die leaving lawful issue him or them surviving then the share of such Son or Sons so dying to go to the issue of such Son or Sons for their maintainance and support if necessary And I give and bequeath unto my two Grandchildren Ann and Harriet Sadler children of my Son Ephraim Sadler the Sum of One hundred pounds each out of the share to which my Son Ephraim would be entitled unto at my decease to be paid to them on their attaining the Age of Twenty one years or in Twelve Months after my decease should they have attained that age and in case either of them should die before the said Legacy shall become payable leaving no lawful issue then the Legacy of the one so dying to go to the survivor and if both of my said Grandchildren should die leaving no lawful issue them surviving then the said bequests to go to and be paid to my said Son Ephraim Sadler. And I give and bequeath unto my Grandchildren William and Ann Sadler the children of my late Son Charles the Sum of Fifty pounds apiece the said Legacies to be invested by my said Executors and Trustees until they attain the Age of Twenty five years respectively And I direct that the Interest shall accumulate on such Legacies until they attain that age unless specially required for their support And if either of my last mentioned Grandchildren shall depart this life leaving lawful Issue them surviving then the share of the one so dying to go to such issue in equal proportions if more than one and if no such issue then the said Legacies to be divided amongst my Four Sons John, Ephraim, James and Amos in equal shares. And I hereby further direct and declare that my said Executors and Trustees shall after having paid the Legacies hereinbefore named and the expences also hereinbefore named divide the residue of my personal property between and amongst them my said Sons John Ephraim James and Amos in equal proportions. And I further declare that no Interest shall be paid or claimed by my before mentioned Grandchildren until after the first Twelve Months from my decease And I hereby further direct and declare that the receipt or receipts of the Trustee or Trustees for the time being of this my Will shall alone be good discharges for the purchase money of my said Real Estate and that the purchaser or purchasers thereof or any part thereof or any other person paying them or him any monies and taking such receipt shall not afterwards be required to see to the application thereof nor be answerable for the misapplication thereof neither shall my said Trustees or Executors be answerable for any Banker or Broker for any monies deposited with them or for any loss that may arise from any Sum deposited with them for safe custody Provided always and I do hereby further declare that in case either of my said Trustees shall die or become unable or unwilling to act in the Trusts of this my Will it shall be lawful and I do hereby empower the surviving Trustee or the executors or administrators of such last surviving Trustee to appoint a new Trustee in the room of him so dying or becoming unable or unwilling to act And I do declare that each of my Trustees shall be answerable for his own acts and defaults only and may receive and retain his reasonable Trust expences. And I hereby revoke all former and other Wills by me at any time heretofore made and do publish and declare this only to be and contain my last Will and Testament In Witness whereof I the said Ephraim Sadler the Testator have to this my last Will and Testament written on Two sides of one sheet of Paper set my hand this Eighteenth day of August in the year of our Lord One thousand eight hundred and fifty one — Signed published and declared by the said Ephraim Sadler the Testator as and for his last Will and Testament in the presence of us present with him at the same time who in his presence at his request and in the presence of each other as aforesaid have hereunto subscribed our names as Witnesses — (signed) Ephraim Sadler.
