This is the last Will of me DAVID JOHN POWELL of 25 Raffin Green Lane Datchworth Hertfordshire

1. I REVOKE all former Wills made by me
2. I GIVE all my property whatsoever and wheresoever to my wife GLADYS ANNIE POWELL absolutely Provided that she shall survive me for twenty-one days and APPOINT her sole Executrix of this my Will
3. IF my wife shall not survive me for twenty-one days then in lieu of Clause 2 the following shall apply
4. I APPOINT my nephew NORMAN FRANK PEARMAN and JOHN RICHARD HAWES of 7 Raffin Green Lane Datchworth (hereinafter called "my Trustees") to be Executors and Trustees of this my Will
5. I GIVE the following pecuniary legacies free of all taxes and duties payable by reason of my death (provided that the legatees shall not have become entitled to legacies of similar amounts under the Will of my wife) :-
(a) To the said JOHN RICHARD HAWES if he shall prove this Will and act in its trusts the sum of Three Hundred Pounds (£300.00)
(b) To my wife's sister VERA MARY SAPSED the sum of Two Thousand Pounds (£2,000.00)
(c) To the said NORMAN FRANK PEARMAN the sum of Ten Thousand Pounds (£10,000.00)
(d) to the CANCER RESEARCH CAMPAIGN the sum of Two Hundred Pounds (£200.00)
(e) To the ROYAL NATIONAL INSTITUTE FOR THE BLIND the sum of Two Hundred Pounds (£200.00)
The receipts of the Treasurers for the time being of the above mentioned charities shall be sufficient discharge to my Executors for the legacies given to them
6. I GIVE all the remainder of my property to my Trustees UPON TRUST (a) either to retain or sell it and to pay debts and death duties and executorship expenses (b) to hold the net residue thereof (i) as to one half thereof equally for my great niece CLAIRE SUZANNE PEARMAN and my great nephew DAVID CHARLES PEARMAN or for the survivor of them living at my death who shall attain twenty-one or marry PROVIDED that if either of them shall not attain a vested interest but leave a child or children such child or children who shall attain twenty-one or marry shall take equally if more than one the share which his her or their parent would have taken (ii) as to the other half thereof equally for DAVID LESLIE HENRY SMITH of 2 Scripp Cottages Foxhunt Waldron Near Heathfield Sussex and his daughter JOANNE NICOLA SMITH or the survivor of them living at my death and in the case of the said JOANNE NICOLA SMITH on her attaining twenty-one or marrying provided that if she shall not attain a vested interest but leave a child or children such child or children who shall attain twenty-one or marry shall take equally if more than one the share which their parent would have taken
7. MY TRUSTEES shall have power (a) to invest and change investments as freely as if they were beneficially entitled This power includes the right to invest in unsecured interest free loans or other non-income producing assets including property for occupation or use by a beneficiary and (b) in their absolute discretion to use the whole or any part of the capital or income of the presumptive share of any beneficiary under the age of twenty-one for his or her maintenance education advancement or benefit
